Prof Tom Ojienda SC

As a robust litigating counsel, Prof. Ojienda, SC, has successfully handled numerous landmark cases at the Supreme Court in electoral law and dispute resolution, Land law, Family law, Commercial and other areas of Law. He represents various individuals, state agencies, private entities, county governments and multinational agencies. He has represented these entities in Kenyan courts from the Subordinate Courts, all the way to the Supreme Court.

Represented Narok County Government in a matter involving unlawful acquisition of over 4,000 acres of land belonging to Maasai Mara National Reserve.

Successfully acted for the National Land Commission in a matter where it was accused of unlawfully acquiring, sub-dividing and allotting considerable portions of land without consent of the registered proprietors.

Successfully represented one Mr. Baumgartner in a suit challenging his title to the suit land and properties worth KES 100m.  

Successfully acted for Cornerstone Preparatory Association in a matter challenging the legality of titles to various plots of land owned by Cornerstone and other parties.

Acting for Numerical Machining Complex in a land proprietorship dispute involving over 500 acres of land worth KES 8b.

Successfully acted for Hon. Cyprian Awiti and Hon. Hamilton Orata in the Supreme Court after their election into Gubernatorial office was annulled by the High Court.

Successfully acted for Hon. Mohamed Abdi in the Supreme Court after his election as Governor of Wajir was annulled by the High Court.

Successfully acted for IEBC in a matter challenging the ability of the commission (as then constituted) to carry out its constitutional mandate.

Acted for Lenny Maxwell Kivuti in his Supreme Court petition that challenged the election of Martin Nyaga Wambora as governor of Embu county. 

Acted for IEBC in a petition challenging the commission’s decision to send its (then) CEO on compulsory leave.

Successfully represented the 47 speakers of county assemblies in a matter challenging the establishment of County Development Boards.

Acting for King Woollen Mills Limited and Galot Industries Limited in a Supreme Court matter involving approximately KES 251m.

Acting for the Public Service Commission (PSC) in a matter calling upon the Court to determine a number of Constitutional questions, including whether PSC has powers to pay sitting Members of Parliament a monetary housing benefit totalling KES 1.2b annually.  

Acting for former governor Dr. Evans Kidero in a matter challenging the Capital Markets Authority’s (CMA’s) decision to allegedly investigate the former governor’s personal bank accounts from year 2006-2016.

Acted for Landmark Freight Services Limited in a constitutional petition challenging a government parastatal’s decision to destroy Landmark’s 5,580 metric tonnes of imported sugar worth KES 600m.

Represented Kwale Sugar in Court after a governmental multiagency team wrongfully closed down its sugar factory worth KES 4b located in Ramisi, Kwale.

Represented Kevin Omondi Ochieng and 38 others in Court after they were arrested and detained without charge for alleged loss of revenue at Kenya Revenue Authority.
